Service
By purchasing the services of Xpancom, LLC, D.B.A. MonsterCovers.com (herin referred to as 'MonsterCovers.com') as a Client, you agree to be legally bound by these Terms Of Service, including those Terms Of Service incorporated by reference. If you do not accept these Terms Of Service stated here without modification, you may not use the services provided by MonsterCovers.com. MonsterCovers.com may modify these Terms Of Service at any time.

Payment
All prices listed on MonsterCovers.com are in US Dollars. All work must be paid in advance prior to any design work commencing. Clients purchasing MonsterCovers.com's Service must pay for the Service online via PayPal or offline via telephone using a major credit card. Client's will be charged for the Package(s) selected. If you pay by credit card, you will be required to provide a valid credit card number and your credit card billing address when you register as a Client. MonsterCovers.com will email the client a receipt for the transactions in which Client is involved.

Ownership
All final artwork become the property of the Client, having unlimited and royalty-free use of the image upon payment of all fees. MonsterCovers.com retains the right to display the artwork in their portfolio and advertising materials.

Client Security
MonsterCovers.com will take appropriate steps to prevent unauthorized access, maintain data accuracy, and ensure the correct use of the information you provide us. Whenever you give MonsterCovers.com sensitive information, MonsterCovers.com will take reasonable steps to establish a secure connection with your web browser.

Disclaimer
The Client unconditionally guarantees that any element of text furnished to MonsterCovers.com for inclusion in the design samples do not infringe on any copyright or trademarks that have been already established by another organization. The Client will hold harmless, protect, and defend MonsterCovers.com and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.

MonsterCovers.com guarantees the Graphical Designs provided to Clients are uniquely created by MonsterCovers.com. By purchasing the services of MonsterCovers.com, the Client understands the Graphical Design provided may resemble a copyright image. Should a case as this arise, MonsterCovers.com will re-design the Graphic.

Project Duration
Client agrees to provide timely responses to MonsterCovers.com after notification of sample completion. Client shall have 30 days to respond to each set design samples submitted to the Client for review. If after 30 days the Client has failed to respond, MonsterCovers.com will assume the Project complete and the Project shall be deemed to be complete. MonsterCovers.com will have no further obligation to Client, and Client shall pay MonsterCovers.com all fees and expenses associated with work performed by MonsterCovers.com.

Revision
For the Custom Sales Package, MonsterCovers.com will charge $40 after the 4th revision. No revision work, which requires payment, will be started without authorization from Client.

Refund Policy
A full refund less an administration charge of $50 will be made if the Client does not wish to proceed with the design before the initial design samples are created.

The refund policy will also not take into affect if:
1 ) The reason does not relate to our design.
2 ) You do not provide any feedback within 1 month.
3 ) You have obtained Graphical Design from a 3rd party.

Logos, Slogans, Flash Design, Rush Orders, Web Site Designs are non-refundable.

Eligibility Requirements
By registering as a Client, you represent and warrant that the information you include as part of the registration process is complete and accurate and, if you are registering on behalf of an entity, that you are authorized to bind that entity to these Terms Of Service. MonsterCovers.com may accept or reject your registration in its sole discretion.

Termination
MonsterCovers.com reserves the right, in its sole discretion, to terminate Client's access to all or a portion of the Service, at any time, with or without notice. In the event of such termination, MonsterCovers.com will work with Client to determine the amount of any refund (if any) to be paid to Client as a result of such termination. Should Client's use of the Service result from Client's material breach of the Terms Of Service of this Agreement, Client shall not be entitled to any refund, unless otherwise mutually agreed upon by the parties.

Operation of Web Site
MonsterCovers.com shall not be responsible for any delays, interruptions, errors, omissions the may occur on the Web Site. MonsterCovers.com reserves the right, but shall not be required, to correct any delays, interruptions, errors or omissions. Various circumstances may prevent or delay availability of the Web Site, therefore, MonsterCovers.com makes no representation, warranty or covenant that the Web Site or Service will be available at all times or at any time. MonsterCovers.com shall not be responsible for any loss, cost, damage or liability that may result.
